What is BSL?

BSL is an ethical failure. BSL is a public safety failure.

Description

Breed-specific legislation (BSL) bans or restricts certain types of dogs based on their appearance because they are perceived as “dangerous” breeds or types of dogs.

A breed ban usually requires that all dogs of a certain appearance (“targeted breed”) be removed from the area wherein the BSL has been implemented.

Breed-specific restrictions may require an owner of a targeted breed do any of the following or more, depending on how the law is written:

  • Muzzle the dog in public
  • Spay or neuter the dog
  • Contain the dog in a kennel with specific requirements (6′ chain link walls, lid, concrete floors, etc.)
  • Keep the dog on a leash of specific length or material
  • Purchase liability insurance of a certain amount
  • Place “vicious dog” signs on the outside of the residence where the dog lives
  • Make the dog wear a “vicious dog” tag or other identifying marker

Breed-specific legislation applies only to dogs of a certain appearance, not to any and all dogs. It does not take into account how the owner has raised, trained, or managed the dog. It does not take into account the dog’s actual behavior.

Please contact legislators and educate them on the breed and how BSL helps no one and only hurts responsible owners.  This can be done by sending letters by regular mail or email.  Please be respectfull and polite.  Here is an example letter.  Please feel free to copy and paste and use.

 

Dear Mayor Doe:

 

I am writing to you about the recently proposed ordinance that would ban pit bulls from (town of possible BSL).  Passage of this ordinance will not address the root cause of the problem, and it will have a negative impact on responsible, law abiding dog owners, while those who do not abide by the law will simply continue to do so.  I am strongly opposed to this ordinance, and I ask that you vote against it for the following reasons:

A much better alternative to breed-specific legislation is to support reasonable, enforceable, non-discriminatory laws to govern the ownership of dogs and to hold irresponsible dog owners to a higher accountability.

I ask that you oppose this proposal because any such law that is specific to breed does not address the real problem, which is that of irresponsible dog owners.

Elkhart pit bull ban falls just short
A motion to ban the breed failed on a tie vote of 4 to 4.

ELKHART -- It came down to one vote.
 
The Elkhart City Council met Wednesday to continue its discussion on the proposed animal control ordinance. While much of the night's discussion revolved around technical changes, Councilman Brent Curry, D-5th, wanted to get back to the original discussion that began more than 18 meetings ago.
 
He attempted to ban pit bulls in the city limits after July 1. He had support, but it wasn't enough.
 
His motion failed on a tie vote of 4 to 4. A tie vote defeats the amendment.
 
Voting in favor of banning the breed were Curry and Council members Ralph Bean and Rod Roberson, both D-at large; and Tonda Hines, D-6th. Voting against were Councilmen Brian Thomas, R-2nd; David Henke, R-3rd, Ron Troyer, D-4th; and David Osborne, D-1st.
 
Council member Mary Olson, R-at large, left the meeting early.
 
The discussion was emotional, with passionate pleas by Hines and Roberson to consider that pit bulls are a public safety problem, particularly in certain areas of the city.
 
"This is what generated us to look at this ordinance," Hines said. "It's real. It's not perception in some areas. It's reality in others. It (the proposed ordinance) still has not helped with that reality. ... How do we not do breed-specific? "
 
Other council members echoed Thomas, who said it's the owners who are the issue, not the dogs. "We've got teeth in this ordinance," he said.
 
The council will meet again as the Public Health and Safety Committee as a whole to consider further changes in the ordinance, but not until a final draft is complete. No date has been set.
 

FLORIDA

Currently, Florida state law 767.14 prohibits municipalities from passing BSL.
On December 28, Florida Representative Perry Thurston filed a bill which would remove this statewide protection. If HB 543 passes, any municipality in Florida could pass BSL or breed-specific bans.
 
The bill has not been placed in a committee yet. The bill status and text may be viewed here:

At this stage, Florida residents should contact their state representatives and let them know that this bill is not acceptable.

Rep. Thurston is a long-time proponent and supporter of BSL who has introduced similar bills in every session since 2007 (last year’s bill was
HB 189, which died in committee), so this move is not unexpected. Please keep any correspondence with Rep. Thurston polite, and be aware that he’s unlikely to listen to opposing points of view. The only way to stophimis to vote him out in 2010.

 

Florida: HB 543 now in committee

Florida state law prohibits municipalities from passing breed-specific legislation. HB 543 would remove that prohibition and make it possible for any municipality in Florida to pass BSL.
HB 543 has moved to the Agriculture and Natural Resources Policy Committee.

Due to the nation's crashing economy, animal shelters are even more stretched for space in their facilities. Because of our big hearts, we are always looking to get involved and not look the other way as so many other organizations have done. We've got many fur babies looking for forever homes. We have many new items for sale at the "Pit Store".  We have had many comments about the old photos on the new website and when I find time I love making crafts out of them.  So, now we have a few items with the old photos on them!  We will be adding more items including candels!!!!
